Why Every Senior Should Have These 3 Notarized Documents

As our loved ones age, having the right legal documents in place becomes increasingly important. Three notarized documents in particular can make an enormous difference when health challenges arise unexpectedly.

1. Durable Power of Attorney (DPOA)

A Durable Power of Attorney allows a trusted family member or friend (the "agent") to manage financial affairs on behalf of the senior if they become unable to do so themselves. Unlike a general POA, a durable POA remains in effect even if the principal becomes incapacitated.

Without a DPOA, families may need to go through a costly and time-consuming court conservatorship process to gain authority to pay bills, manage bank accounts, or handle property.

2. Advance Healthcare Directive (AHCD)

An Advance Healthcare Directive (also called a "living will" + healthcare POA) has two parts: it names a healthcare agent who can make medical decisions, and it specifies the senior's wishes for end-of-life care.

California hospitals and healthcare facilities are required to honor valid AHCDs. Without one, medical decisions may be made by healthcare providers according to standard protocols — which may not align with the patient's wishes.

3. A Revocable Living Trust

A revocable living trust allows assets to pass to heirs without going through California probate court — a process that can take 12–24 months and cost 4–8% of the estate value. Trust documents must be signed and notarized to be legally effective for transferring real property.
