These Terms of Service ("Terms") govern your use of the Bay Area Mobile Notary Services website and notary services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1 Services Provided

Bay Area Mobile Notary Services provides mobile notary public services throughout the San Francisco Bay Area. Our services include:

  • General notarization of documents
  • Loan signing and real estate document notarization
  • Legal and estate planning document notarization
  • Medical and healthcare-related document notarization
  • Senior and hospital visit notary services
  • Business and corporate document notarization
  • DMV and vehicle title document notarization

Our notaries are commissioned by the California Secretary of State and perform services in compliance with California notary law.

2 Appointment Scheduling and Cancellation

Scheduling

Appointments may be scheduled by phone, text, or through our website. Same-day and urgent appointments are subject to availability. We will confirm your appointment and notify you if we are unable to accommodate your requested time.

Cancellations

We ask that you provide at least 2 hours notice for cancellations. Cancellations made after a notary has already departed for your location may be subject to a partial travel fee. For same-day appointments, please call us directly to cancel.

No-Shows

If you are not present at the agreed-upon location and time without prior cancellation, a trip charge may apply to cover the notary's travel time and fuel costs.

3 Fees and Payment

Notary Fees

California law sets the maximum notary fee at $15.00 per notarial act. Our fees comply with this limit. We provide a fee estimate before your appointment and there are no hidden charges.

Travel Fees

In addition to the notary fee, a travel fee is charged to cover transportation to your location. Travel fees vary based on distance and are disclosed upfront before you confirm your appointment.

Payment Methods

We accept cash, check, and most major credit/debit cards. Payment is due at the time of service unless other arrangements have been made in advance.

4 Client Responsibilities

To ensure a successful notary appointment, you are responsible for:

  • Valid Identification: Providing a current, government-issued photo ID (driver's license, passport, military ID, or state ID) as required by California law.
  • Unsigned Documents: Presenting documents that have not yet been signed. Do not sign documents before the notary arrives.
  • Competency and Willingness: Being of sound mind and acting of your own free will. Our notaries cannot proceed if they have reason to believe a signer is incompetent or acting under duress.
  • Accurate Information: Providing accurate information about the documents to be notarized when scheduling your appointment.
  • Safe Environment: Providing a safe and accessible location for the notary to perform the notarization.

5 Limitations of Notary Services

Our notaries perform ministerial acts as defined by California law. It is important to understand that:

  • Notarization does not constitute legal advice or an opinion on the validity or legality of a document.
  • Our notaries cannot advise you on what documents to sign, whether you should sign, or what legal effect a document will have.
  • Our notaries cannot prepare legal documents for you — they can only notarize documents that are already prepared.
  • Notarization does not guarantee that a document will be accepted by any government agency or other entity.
  • California law prohibits notarizing certain documents, including vital records (birth/death certificates) and certain immigration documents.

6 Right to Refuse Service

Our notaries reserve the right to refuse or decline to perform a notarization if:

  • The signer cannot be properly identified
  • The signer appears to be under duress or lacks mental capacity
  • The document appears to be incomplete or fraudulent
  • The notarization would be contrary to California law
  • The notary has a conflict of interest in the transaction
  • The environment is unsafe or the notary feels threatened

In such cases, the travel fee may still apply if the notary has already traveled to your location.

7 Limitation of Liability

Bay Area Mobile Notary Services shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services. Our liability for any claim arising out of or relating to our services is limited to the fees paid for the specific notarization service in question.

We are not responsible for errors in documents presented for notarization, the legal effect of notarized documents, or the acceptance or rejection of notarized documents by any third party.

8 Website Use

By using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the website
  • Transmit any harmful, offensive, or disruptive content
  • Scrape, crawl, or systematically collect data from the website without permission
  • Interfere with the proper operation of the website

We reserve the right to terminate access to our website for any user who violates these terms.

9 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Alameda County, California.

10 Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms to our website with a revised "Last Updated" date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
